TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (agents, builders, developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement, the Listing Agreement shall prevail regarding listing specifics.

2. Description of Services

HALP operates property discovery and business directory platforms including halp.com.au and boutiquedevelopments.com.au. We facilitate connections between property seekers and property providers (developers, builders, agents) and mortgage brokers. HALP is not a real estate agent, developer, builder or financial advisor.

Property listing inquiries submitted through our platform go directly to the listing agent, developer or builder. Platform inquiries (Contact Us, Join Us, Advertise With Us) are managed by HALP.

3. User Accounts and Registration

You must be at least 18 years of age. You are responsible for keeping your account credentials confidential and for all activity under your account. We may suspend or terminate accounts that breach these Terms.

4. User Conduct and Prohibited Activities

You agree to comply with all applicable laws and to use our services in good faith. You must not misuse our platforms, upload harmful content, engage in illegal activity, harass other users, or attempt to compete with or scrape our services.

5. Property Listings and Information

Property listings and information are provided by third parties. HALP does not verify all listing information and disclaims warranties as to accuracy, completeness, availability or fitness for purpose. Always verify critical details — including school zones — directly with the property provider, education department or relevant school.

6. Business Directory Listings

Advertisers must hold a valid ABN or ACN, provide accurate information, comply with Australian Consumer Law and hold necessary licenses. Free and premium listings are subject to acceptance and our subscription terms.

7. Payment Terms (Advertiser Subscriptions)

Fees are in AUD and displayed exclusive of GST unless otherwise stated. Payments are processed via Stripe. Subscriptions auto-renew unless cancelled. Pricing may change on 30 days' notice.

Cancellations take effect at the end of the current billing period. There are no refunds for voluntary cancellations, but pro-rata refunds apply for technical issues preventing service access. Refunds are processed within 14 business days.

8. Intellectual Property Rights

All content, logos, trademarks, software and design on our platforms are owned by HALP or licensed to us. You are granted a limited, non-exclusive, non-transferable license to access and use our platforms for personal, non-commercial purposes.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, legal, tax or real estate advice. Our services are provided "as is" and "as available". We are not responsible for third-party conduct or the accuracy of third-party listings.

10. Limitation of Liability

To the maximum extent permitted by law, HALP excludes liability for direct, indirect, consequential and incidental damages. Where liability cannot be excluded, it is capped at $100 AUD for free services or, for paid services, the lesser of $1,000 AUD or the amount paid to us in the prior 12 months. Nothing in these Terms excludes rights under the Australian Consumer Law.

11. Dispute Resolution

Before commencing legal proceedings, contact legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia, and disputes are subject to the exclusive jurisdiction of NSW courts. Optional arbitration in Sydney is available under ADRA rules.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is unenforceable, the remainder continues in force. Our failure to enforce any provision does not waive our right to do so later. You may not assign these Terms without our written consent.

13. Special Terms for Specific Services

Mortgage calculators, school zone data and property alerts are provided for general information only. Always verify school catchments directly with the relevant school and education department — enrolment in a school is not guaranteed by living in a catchment zone.
